1 Agreement of the general saleing conditions

1.1 The present contract applies only to the hypothesis in wich the transaction between the parts is made by means of internet communication and does not involve therefore other forms of transaction than those already explained.

The contract stipulated between Pinna Srl and the Customer concludes when the order is accepted by Pinna Srl.
The E-commerce contract is to be considered concluded on the date that the e-communication that contains the acceptance has been received and registered by Pinna Srl's System,in it's seat. By making the order in different ways that we propose,the Customer declares that took into consideration all the indications provided in the saleing procedure and that agrees completely with the general saleing conditions described bellow.

1.2. If the customer is a direct user (and therefore an individual that buys products for his/her's own use and don't interfere with their own activity).Once concluded the on-line buyins process,will save or print one copy and will preserve the General Saleing Conditions.,pursuant to the regulations established by the Article 3 and 4 of the Legislative Decree 185/1999 regarding distance trade. The two parts agree not to contest the validità of the present e-commerce contract.

1.3. The Customer is not entitled to claim indemnity or compensations,or for direct/in direct damages to persons or things,if those are caused by the refusal of an order. The parts have the responsability to ensure tha the System will register and elaborate the e-communications in short time after those were received.
The parts have the obligation to store by any mean,unchanged all the e-communications for at least 10 years ,in the exact form that were sent or received. Following the request of one of the parts the other part has the obbligation to confirm the receivement and that the received e-mail was properly saved,as a proof for further misunderstandings that may occure.

2 Transaction possibilities

2.1 The Customer can buy only the products presented on the e-catalogue at the moment of the order and those that can be seen on-line,as described in the information table.
The image of the product is just indicative,may not be perfectly rapresentative for the product wich may have different variations:colours,dimensions,accesories,presented in the table.All the information that support the buying process (Glossare,Buying Guide a.s.o.)are just indicative information materials,and do not refer to characterics of a single product.

2.2 Minimum limit to an order
There is no minimum limit to an order.

2.3 The correct receivement of an order is confirmed by Pinna Srl with an answer by e-mail sent to the e-mail adress that the Customer provided in the order sheet.The messagge will contain Date/Time of the execution of the order,number of the Customer's order form,that can be used in future communications also. The message include also all the data that the Customer provided,and that has to ensure that the data is correct,and must comunicate immediately changes or errors in the data,in the way described in this document.
The message also includes the general conditions of the transactions.

2.4 If the order was not accepted Pinna Srl guarantees in short time that will inform the customer.

3 Payment types

3.1 Credit transfer
This type of payment can be used for buying any articles of the catalogue. Eventual limits will be specified near the shopping cart. In case of credit transfer payment the goods that the customer order are considerated pledged until the confimation of the payment that will be sent to Pinna Srl (fax or e-mail) in no more than 3 days from the day of the acceptance of the order. The shipments of the goods that were ordered will be excecuted when the payment has been done on the bank account of Pinna Srl that should be done in no more then 7 days and not after from the date of acceptance of the order. If those limits are passed the order will be automatically cancelled.
The cheque should be written for Pinna Srl via B.Buozzi 38 25125 Brescia.

On the cheque should be written :
-Reference number of the order;
-Date of the order ;

3.2 Postal credit transfer
This type of payment can be used for buying any articles of the catalogue. Eventual limits will be specified near the shopping cart. The safety of the data transfered is assured by the Banking Insitute abilitated to cryptate the data directly on it's portal.

4 Ways of shipment and costs

4.1 Pinna Srl is allowed to take orders only from the European territory.

4.2 For every order Pinna Srl will issue an invoice for the good that are shipped.For issueing the invoice Pinna Srl will trust the data that the Customer supplied durino the ordering process.
No changes will be possibile after the invoice was issued.

4.3 Delivery costs are payed by the buyuer.
The payment of the goods will be done by the customer by using the type written on the order.
The customer will pay exactly the same that is equal to the total of the order.

4.4 In all cases of necessity and/or force majeure, Pinna Srl will not be responsable for the delay or lack of execution of the shipment and will have the right to resolve all or part of the contract or suspend or to postpone the execution.

4.5 At the moment of the delivery from the carrier the customer has the obbligation to control the integrità of the packing, that it is not damaged or wet or alterated in anyway, even in the closing points (adhesive tape).
Further damages must be immeditely contested with the carrier that was encharged with the shipment.
Once the carrier's document was signed the customer will not be able anymore to contest the external characteristics of what was delivered.
Further problems regarding the phisical integrity, the corrispondence and the completeness of the received products must be signalated in no more than 8 days from the delivery date in the ways described in this document.

4.6 In case of missed withdrawal in 5 days time ofthe unclaimed goods that remaind in the carriers warehouse because of the impossibility of the delivery to the adress indicated by the customer in the order sheet, the order will be automatically cancelled.

5 Prices

5.1 Prices include VAT and comform with the price list in force at the moment of the order.

6 Recessing right

6.1 Pursuant to the regulations estabilished by the legislative decree (art. 5 185/'99) if the customer is a user (therefore an individual that buyes the goods for ogher purposes then professional activity, therefore does not indicated in the order sheet VAT), has the right to retreat from the saleing contract for any reasons, without furnishing further explanation, and without penalties, exept reasons described at point 6.2..

6.2 To benefit this right the customer has to comunicate that to Pinna Srl, in no more than 10 days from the goods delivery date, and confirm that in a registered mail with return confirm strictly in 48 hours.
Once the retreat comunication was sent to us, the customer care will immediately,even by e-mail and comunicate to the customer the instructions regarding sending back the goods that will arrive to Pinna Srl in no more 10 days from the authorisation.

6.3 The right of withdrawal has some conditions: the right applies only to products buyed integraly; is not possible to retreat only for part of the product (accesories, a.s.o).
The buyed goods has to be entire and sent back in it's original packing box complete in all of it's parts.
By the law, shipment expenses relative to the return of the goods are on the customers expenses.
The delivery to our warehouse, is on cutomer's resonsability.
In case of damages of the goods during the shipment, Pinna Srl will comunicate the facts to the customer in no more than 5 days from the delivery of the goods in the warehouse), to consent the customer to make a complain to the carrier that he/she choosed and get the compensation of the value of the goods (if assured); in this case the product will be put to the customer for the returnal at the same time canceling the withdrawal request.
Pinna Srl is not responsable in any way for the damages,caused by the lack of assurance.
At the delivery to the warehouse the product will be examinated to evaluate damages that are not consequence of the shipment if the original package is in any case damaged Pinna Srl will provide to keep the equivalent of 10% from the total that rappresent the restoring expenses.

6.4 Pinna Srl will deduct to the customer the total sum alredy paid for the product, after charging the customer for the eventual restoring expenses, excluding the accessories expenses in no more than 30 days from the returnal of the goods reversing the bank credit transfer. In this last case the customer will provide all the necessary bank account details to obtain the reversing. (IBAN BIC SWIFT, bank account of the holder's)
The withdrawal right is declined if the essential conditions of the integrity of the product (packing and contents) is not respected in the case Pinna srl established that:
-the packing box is missing
-the product is not entire
-the product is damaged.
In case that the right of retreat is declined Pinna Srl will provide to give back the goods charging the shipment expenses.

7 Warranties

7.1 Warranties limits are specified on each one of the products.
Where it isn't written is available the supplier's warranty.
The eventual indications in the catalogue for the products that weren't produced by Pinna Srl are just informative and does not make Pinna responsable for the choice or use of the products.

7.2 No kind of payments can be request to Pinn Srl for eventual replacements or repairs.

7.3 In case that the applications of the warranty specifically provides giving back the product the goods must be hand back in the original packing box, complee in all of it's parts.
To limit damages to the original packing we reccomend, when possible, to put it in a second box; avoid in any case applying sticks or adhesive tapes on the original packing of the product.

9 Reclamations

9.1 Eventual reclamations must be fowarded to Pinna Srl Via B. Buozzi 38 25125 Brescia (italy)

10 Applying laws

10.1 The saleing contract between Pinna Srl and customer is concluded in italy and is regulated by italian law.
